By accessing and using Shiftur's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Services Description
Shiftur provides digital solutions including but not limited to:
- Web and mobile application development
- Amazon marketplace services
- Digital marketing solutions
- AI-enhanced business solutions
- Graphic design services
- Consultation and strategy services
3. Project Terms and Payment
All projects are subject to the following terms:
- Project scope and deliverables will be defined in a separate project agreement
- Payment terms will be specified in the project proposal
- Changes to project scope may result in additional charges
- Final payment is due upon project completion and delivery
- Late payments may incur additional fees
4. Intellectual Property
Upon full payment, clients receive ownership of custom work created specifically for their project. However:
- Shiftur retains rights to general methodologies and techniques
- Third-party components remain property of their respective owners
- Shiftur may showcase completed work in portfolios unless otherwise agreed
- Clients must respect third-party licenses and copyrights
5. Client Responsibilities
Clients are responsible for:
- Providing accurate and complete project requirements
- Timely feedback and approvals
- Providing necessary content, images, and materials
- Ensuring they have rights to all provided materials
- Making payments according to agreed terms
6. Warranties and Disclaimers
Shiftur provides services "as is" and makes no warranties, expressed or implied. We disclaim all warranties including but not limited to:
- Merchantability and fitness for a particular purpose
- Non-infringement of third-party rights
- Uninterrupted or error-free operation
- Specific results or outcomes
7. Limitation of Liability
Shiftur's liability is limited to the amount paid for services. We shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Third-party claims or actions
- Force majeure events beyond our control
8. Confidentiality
Both parties agree to maintain confidentiality of proprietary information shared during the course of the project. This includes:
- Business strategies and plans
- Technical specifications and code
- Customer data and lists
- Financial information
9. Termination
Either party may terminate services with written notice. Upon termination:
- Client pays for work completed to date
- Shiftur delivers completed work upon payment
- Both parties return confidential information
- Survival clauses remain in effect
10. Support and Maintenance
Post-launch support terms:
- Bug fixes are provided for 30 days after launch
- Ongoing maintenance requires separate agreement
- Emergency support may incur additional charges
- Updates and enhancements are quoted separately
11. Governing Law
These terms are governed by the laws of Maryland, United States. Any disputes will be resolved through:
- Good faith negotiation first
- Mediation if negotiation fails
- Binding arbitration as final resort
- Maryland courts for enforcement
12. Changes to Terms
Shiftur reserves the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of services constitutes acceptance of modified terms.
